Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out rules that apply when a Customer or its Users access or use the BankSearch “Services” including BankSearch CRM and other SaaS platforms and websites. Capitalised terms follow the Customer Terms of Service.
1. Prohibited Content & Activities
Users must not upload, store, transmit, or promote content that:
1.1 Violates any applicable law or regulation (e.g. data protection, export control).
1.1.2 Is threatening, defamatory, obscene, pornographic, harassing, hateful, discriminatory, blasphemous, or otherwise unlawful.
1.1.3 Infringes intellectual property or privacy rights of any third party.
1.1.4 Contains malware, viruses, malicious code or corrupted or harmful data.
1.1.5 Includes “special category data” (UK GDPR Art 9) or Sensitive Data under PDPL (e.g. health, biometrics) unless the Customer has obtained an appropriate lawful basis and flagged such fields to BankSearch in advance.
1.2 Users must not use the “Services” or website:
1.2.1 in any way that breaches any applicable local, national or international law or regulation.
1.2.2 in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
1.2.3 for the purpose of harming or attempting to harm minors in any way.
1.2.4 for which they have not obtained all necessary licences, consents and/or approvals.
1.2.5 to send, or enable the sending of, unsolicited or unauthorised advertising, marketing, or promotional messages via email, SMS, WhatsApp, Facebook Messenger, or any other communication platform, including through third-party integrations such as ManyChat or via automated webhooks.
2. Platform Integrity
Users must not:
2.1 Probe, scan, or test the vulnerability of any BankSearch system without written consent.
2.2 Circumvent authentication or security controls.
2.3 Access (or attempt to access) the Service via automated means other than BankSearch’s authorised APIs.
2.4 Interfere with or disrupt the Service, including denial of service attacks or excessive use that could impair others.
2.5 Use the Services in a manner that results in excessive consumption of system resources or attempts to avoid payment (e.g. repeated trial signups or account farming).
3. Customer Authorised Integrations
3.1 The Customer may connect third party tools (e.g. booking, messaging) via API keys. The Customer is solely responsible for ensuring that such tools comply with this AUP and relevant data protection laws.
4. Enforcement & Suspension
4.1 BankSearch may suspend or terminate access to the Service (or remove specific content) if they believe, in good faith, that a User or Customer has breached this AUP or the law.
4.2 Where practical, BankSearch will provide notice and an opportunity to cure before suspension.
4.3 BankSearch reserves the right to investigate suspected violations of this AUP and to take any action it deems necessary, including cooperation with law enforcement or affected third parties.
4. Enforcement & Suspension
4.1 BankSearch may suspend or terminate access to the Service (or remove specific content) if they believe, in good faith, that a User or Customer has breached this AUP or the law.
5. Reporting Violations
Suspected violations should be reported to privacy@banksearch-consultancy.com.
Failure to comply with this AUP may result in immediate suspension or termination of the Service without refund and may expose the Customer to civil and criminal liability.
6. Changes to This Policy
We may revise this Acceptable Use Policy from time to time. Material changes take effect 15 days after posting here and we may notify users by email or in-app message.
